Real estate expertise in the context of divorce or separation in Brussels

The dissolution of a couple — whether by divorce, judicial separation or the end of a legal cohabitation — almost always raises the question of the division of real estate assets. Whether the spouses are married under the legal community regime, under a separation of property regime with a participation clause, or are legal cohabitants, the determination of the fair market value of the jointly held property is a key step in the process.

Belgian divorce law is governed by the Civil Code (articles 229 et seq.). Two procedures coexist:

Divorce by mutual consent (article 230)

The spouses agree on all aspects of the separation, including the fate of the property. The notary drafts the preliminary agreement, which must state the agreed value of the property. A valuation report secures this agreement by providing an objective basis, preventing either spouse from subsequently claiming prejudice.

Divorce for irretrievable breakdown (article 229, §1 and §3)

When the spouses cannot reach an agreement, the family court orders the liquidation and partition of the matrimonial regime. The notary-liquidator appointed by the judge must then establish the pool of assets to be divided. The valuation of the properties forms the core of this process. The court may appoint a judicial expert, but the parties may also produce private valuation reports to support their position.

The end of legal cohabitation (article 1476 of the Civil Code) entails the dissolution of joint ownership of assets acquired jointly. The same valuation principles apply.

Why a certified expertise is indispensable

In the emotionally charged context of divorce, the value of the property is often a major source of friction. One party may wish to buy out the other’s share, or both may disagree on the price in the event of a sale. An independent real estate expertise provides:

  • Objectivity: The expert has no interest in the dispute. The valuation is based on verifiable data.
  • Judicial admissibility: The reasoned report signed by a certified expert constitutes evidence before the family court.
  • Legal certainty: In the case of a buyout, the value established by the expert protects the buyer against a subsequent tax reassessment.
  • Acceleration of proceedings: A clear and well-argued report reduces points of contention and facilitates negotiation.

Content of the valuation report in divorce proceedings

The report includes:

  • Detailed description of the property: Location, composition, surfaces (in accordance with the NBN standard), state of upkeep, energy performance.
  • Analysis of the legal context: Matrimonial regime, any right of pre-emption, occupation of the property (by one of the spouses, by a third-party tenant).
  • Market references: Recent comparable transactions in the same district or commune in Brussels, data from the notarial database.
  • Determination of fair market value: Using the direct comparison method and, where applicable, income capitalisation for a tenanted property.
  • Occupancy discount: If the property is occupied by one of the spouses at the time of valuation, the discount is calculated and justified.
  • Appendices: Photographs, cadastral plan, planning extract, copy of EPC.

How the mission works

Amicable or judicial expertise?

Two frameworks are available:

  • Amicable (private) expertise: Appointed by one or both parties. Faster, confidential and less costly. The report can be submitted in court as probative evidence.
  • Judicial expertise: Ordered by the court. The expert is appointed by the judge and submits a binding report. Our firm accepts judicial appointments.

However, as soon as the value must be enforceable (buyout, notarised liquidation-partition, legal proceedings), a certified expertise is indispensable.

Is the valuation report accepted by the family court?
Yes. Our reports are drafted to the standards recognised by Belgian courts and are regularly produced before the Brussels family courts. The expert may also be judicially appointed at the request of the judge.
Can my ex-spouse contest the expertise?
Each party has the right to appoint their own expert. In the event of persistent disagreement, the court may appoint a judicial expert. However, a well-reasoned and documented report is rarely successfully challenged.
Do both parties need to agree for the expertise to be carried out?
No. Each spouse may unilaterally appoint an expert to obtain a valuation. However, for a so-called adversarial expertise (accepted by both parties), prior agreement is advisable.
